The EAJC condemns the unsubstantiated accusations against Israel

The leadership of the Euro-Asian Jewish Congress strongly condemns the false and groundless allegations brought by South Africa against Israel in its lawsuit before the UN International Court of Justice.

On December 29, South Africa filed a lawsuit accusing Israel of both the intent and the actual commission of genocide during the hostilities in the Gaza Strip. The arguments presented by the prosecution in court amount to nothing more than a superficial, one-sided, misleading, and politically motivated libel against the Jewish state.

As the Israeli defense team correctly asserts, military conflicts are, regrettably, always accompanied by casualties, destruction, and humanitarian crises. Characterizing Israel's actions to protect its citizens as genocide is an empty slogan that defies the essence of international humanitarian law. The prosecution virtually ignores the brutal attack by Hamas terrorists on October 7, which under all norms of international law must be interpreted as a declaration of war, thereby justifying and granting Israel the full right to conduct military operations to protect its civilian population.

The international laws of warfare regulate the balance between humanitarian considerations and military necessity, urging parties to minimize humanitarian harm to the extent possible, while still allowing them to gain military advantages and achieve objectives. The prosecution completely disregards the Israeli military's unprecedented efforts to protect the civilian population—often to the detriment of its own military interests—as well as the provision of humanitarian aid and the legal scrutiny applied to its military operations. Exhaustive evidence of these efforts was presented by the Israeli defense. Furthermore, the inevitable and severe consequences of any military conflict, however tragic, do not in themselves constitute a violation of the laws of war, let much less support grave allegations such as genocide.

In addition, the prosecution has entirely ignored the combat tactics utilized by Hamas terrorists, which in turn violate virtually every law of international humanitarian law, as was also conclusively demonstrated by the defense team.

Presenting statements by Israeli politicians as evidence of genocidal intent is merely a misleading selection of quotes, frequently taken out of context and grossly exaggerated. Moreover, the prosecution failed to provide any evidence that these individual statements shape actual policy or manifest on the battlefield. Many statements by members of the War Cabinet and top military leadership, who directly oversee the operations, regarding the clear objectives of the war, the distinction between enemy forces and the civilian population, and Israel's full commitment to the laws of international humanitarian law, were completely ignored.

Thus, it can be concluded that the prosecution's claims are highly superficial, supported by extremely weak evidence, one-sided, and politically motivated, and therefore do not merit presentation in an international court.

The leadership of the EAJC condemns the cynical exploitation and dilution of such a critical term as genocide, the definition of which in international law was largely shaped following the atrocities of the Holocaust, and calls upon the Court to unequivocally reject the lawsuit and dismiss this shameful proceeding, thereby preserving the Court's reputation as a respected institution of justice.

The leadership of the EAJC also expresses its profound gratitude to the Israeli legal team for their rigorous approach, which has utterly dismantled South Africa's false and baseless accusations.
